By accessing and using Save Cart ("Service," "we," "us," or "our"), you ("Merchant," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Save Cart is a cart abandonment recovery service for Shopify stores that:

• Tracks customer cart abandonment events
• Sends automated recovery emails to customers
• Provides analytics and reporting on recovery performance
• Helps merchants recover lost sales from abandoned carts

3. Merchant Obligations and Responsibilities

3.1 Legal Compliance

You agree to:

• Comply with all applicable laws, including data protection and privacy laws (GDPR, CCPA, etc.)
• Obtain proper consent from customers for cart recovery communications
• Include information about cart recovery in your store's privacy policy
• Provide customers with clear opt-out mechanisms
• Honor customer requests for data deletion or opt-out

3.2 Account Responsibility

• Maintain accurate account information
• Keep your Shopify store active and properly configured
• Ensure your email sending practices comply with anti-spam laws
• Monitor your cart recovery campaigns for effectiveness and compliance

4. Data Processing and Privacy

4.1 Data Controller and Processor Relationship

You (Merchant) act as the data controller for customer personal data. Save Cart acts as the data processor, processing personal data solely on your behalf and according to your instructions.

4.2 Data Processing Agreement

By using this Service, you agree to our Data Processing Agreement (DPA), which governs how we handle personal data on your behalf in compliance with applicable data protection laws.

4.3 Customer Data Rights

You are responsible for handling customer requests regarding their personal data, including access, rectification, deletion, and portability requests. We will assist you in fulfilling these obligations as required by law.

5. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws
• Send spam or unsolicited emails through our Service
• Attempt to circumvent or interfere with the Service's security features
• Use the Service to harm, harass, or violate the rights of others
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service in a way that could damage or impair its functionality

6. Billing and Payment

6.1 Subscription Fees

Service fees are billed through Shopify's billing system. By subscribing, you authorize Shopify to charge your payment method for recurring subscription fees.

6.2 Refund Policy

We offer a 30-day money-back guarantee for all paid subscriptions. If you're not satisfied with our service, you may request a full refund within 30 days of your initial payment or renewal. To request a refund, please contact our support team. Refunds are processed within 5-10 business days. After the 30-day period, subscription fees are non-refundable, but you may cancel your subscription at any time to avoid future charges.

6.3 Payment Disputes

Payment disputes should be directed to Shopify's billing support. We reserve the right to suspend service for accounts with overdue payments.

7. Service Availability and Support

7.1 Uptime

We strive to maintain high service availability but do not guarantee 100% uptime. Scheduled maintenance will be announced in advance when possible.

7.2 Support

Support is provided via email at support@savecart.io. We aim to respond to support requests within 24 hours during business days.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Save Cart and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVECART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Save Cart from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

11.1 Termination by You

You may terminate your account at any time by uninstalling the app from your Shopify store or contacting support.

11.2 Termination by Us

We may terminate your account immediately if you violate these Terms or for any reason with 30 days' notice.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We will delete your data according to our data retention policy unless legally required to retain it.

12. Governing Law
